Who Can Apply For a Permanent Residence Card
Foreigners who meet certain conditions established by law can apply for a permanent residence card in Poland. Here are the main categories of persons eligible to apply for this card:
Persons with Polish origin
Foreigners who can prove their Polish origin (e.g. have Polish parents or grandparents) or hold a Pole’s Card. This is one of the easiest grounds for obtaining permanent residence.
Spouses of Polish citizens
Foreigners who have been married to a Polish citizen for at least 3 years, provided they have been residing in Poland for at least 2 years on the basis of a temporary residence card.
Children of persons with permanent residence or Polish citizenship
A child of a foreigner with permanent residence or Polish citizenship can also obtain a permanent residence card if he or she was born in Poland.
Long-term residents of Poland
Foreigners who have been legally residing in Poland for at least 10 years (e.g. on the basis of tolerated stay – z powodów humanitarnych), or 5 years as refugees or under protection, are entitled to permanent residence.
Persons for humanitarian reasons
Foreigners who have been granted asylum, refugee status, subsidiary protection, or stay in Poland on humanitarian grounds may apply for permanent residence after several years of continuous residence.
Victims of human trafficking
If a foreigner cooperates with law enforcement agencies and has an appropriate temporary permit, he or she can apply for permanent residence after a certain period of residence.
