DRAFT AMENDMENT TO THE SPECIAL ACT: RESIDENCE CARDS FOR FAMILY MEMBERS
On April 5, 2024, a draft amendment to the Act on Assistance to Ukrainian Citizens in connection with the armed conflict in their country was published on the website of the Government Legislation Center. The proposed amendment introduces the following significant changes:
- Extension of Validity of Legal Residence: The proposal extends the validity of residence permits for Ukrainian citizens and certain categories of related foreigners until September 30, 2025.
- Expansion of the Scope of Persons Covered by the Act: The Act now aims to include two additional categories of foreigners: minor children of Ukrainian citizens and minor children of spouses of Ukrainian citizens who do not possess Ukrainian nationality.
- Facilitation of Obtaining Temporary Residence Permits for Family Reunification: Importantly, the requirement to have held a temporary residence permit for a two-year period has been removed. Foreigners under temporary protection can immediately apply for a residence permit for the purpose of family reunification upon obtaining a temporary residence permit by another family member.
- Introduction of a Special Type of Residence Card: The amendment introduces a special type of residence card that transitions the status from temporary protection to temporary residence for a period of three years.
Effective Date: The changes are anticipated to take effect on July 1, 2024.
