Legalization of Employment for Foreigners in Poland
Foreigners can legally work in Poland if they possess one of the following documents:
- Temporary residence permit with access to the labor market
- Permanent residence permit
- Long-term EU resident permit
The foreigner must personally submit the application for such a permit. The voivode issues the decision through an administrative procedure. The waiting time for a decision depends on the complexity of the case and the responsible office – it may take from several months to even a year.
For a temporary residence permit, it is necessary to obtain a labor market test from the district governor confirming the lack of available Polish workers for the position. This permit is issued for a maximum period of 3 years. In contrast, permanent and EU resident permits are indefinite.
The fee for the decision ranges from PLN 340 to PLN 640 and is paid by the foreigner. Once approved, an additional stamp duty of PLN 100 is required for the issuance of the residence card.
When Does a Foreigner Need a Work Permit?

Common cases include those staying in Poland with:
- biometric passport
- visa
- temporary residence card (without labor market access)
Not having a valid permit can result in penalties for the employer and deportation of the employee.
What Is a Work Permit and What Does It Include?
A work permit is an official document issued by the voivode that authorizes a foreigner to work in Poland under specific conditions. The document:
- Identifies the employer
- Specifies the job position
- Indicates the salary
- Defines the duration of employment
Important: the permit is linked to a specific company – it does not authorize the foreigner to work for a different employer.
Types of Work Permits
Type A
Foreigners employed under a contract with a Polish company.
Work Permit Type B
For management board members of Polish-registered companies (if they hold the role for more than 6 months per year).
Type C
Employees of foreign companies seconded to their branch in Poland.
Work Permit Type D
For those involved in international service provision (based on documents of the parent company).
Type E
This type of work permit is for other secondment cases exceeding 3 months, such as international projects.
Seasonal Permit – Type S
For employment in seasonal sectors like agriculture, horticulture, or tourism (maximum 9 months per year).
